Scope of These Terms. These Tekion AI Product Terms ("Terms") are between the Tekion entity providing the Products ("Tekion") and the customer agreeing to these terms ("you"). These terms apply to your access and use of Tekion’s artificial intelligence ("AI") and machine learning features ("AI Products") and are incorporated into either your existing Master Subscription Agreement ("MSA"), or for Tekion AI Products provided to you in beta or trial, your beta or trial agreement with Tekion. Any capitalized terms not defined here have the same meaning as in the MSA or relevant beta or trial agreement.
Use of Tekion AI Features. When you utilize Tekion’s AI Products, you may submit prompts, data, images, questions, or files ("Inputs"). The AI Products generate responses such as answers, reports, designs, recommendations, or code ("Outputs"). Both Inputs and Outputs are considered "Your Data" under your MSA, and you retain all rights, title, and interest in them. Tekion retains all right, title, and interest in the AI Products, including the AI Products and underlying models powering these features and improvements ("Models"), enhancements to the AI Products, and new products and features. No rights or ownership in the underlying technology are granted to you.
Data Usage and Privacy. Tekion uses datasets that may include Your Data, Anonymized, Aggregated, or synthetic data to enhance, train, improve, operate, and develop our Models and AI Products. "Aggregated Data" is created by combining Your Data with data from other sources. "Anonymized Data" is created by removing all identifying information. For more information on Tekion’s privacy practices and obligations, please see the Trust Portal and refer to your Data Processing Agreement.
Quality Review. To ensure accuracy and quality, Tekion may review Inputs and Outputs. This review is conducted for quality assurance, compliance, support, and product development and improvement.
Accuracy and Reliance on AI Outputs. Outputs are automatically generated based on your Inputs and may be inaccurate, incomplete, misleading, or offensive. You remain solely responsible for verifying any Outputs, including using human review, before relying on it or using it for your purpose. Tekion expressly disclaims the accuracy and suitability of any Outputs for your use case, and the content generated by AI does not represent Tekion’s official views nor constitute endorsement of any third-party products or services.
Monitoring and Enforcement. Tekion may use automated tools and human reviewers to monitor usage of AI features. This monitoring helps assist users, maintain quality, improve products, and enforce these terms.
Miscellaneous. Tekion may update these AI Product Terms in the same manner that Tekion may update your MSA, beta, or trial agreement.
